Terms - Net 30 days. The terms stated in Caplugs document govern all sales notwithstanding the use of buyer's purchase order number. Visa, Mastercard, American Express, and Discover are accepted.
Pricing - Consult a Caplugs Sales Representative or Customer Service Representative for Carton and Mini Pak pricing. Pricing can also be found online at www.caplugs.com. Pricing is subject to change without notification.
Material Certification - Caplugs supplies standard material certification with all shipments. Special certification requirements will be reviewed and are subject to a $100 service charge and $50 for lot traceability.
Shipping Point - EXW Buffalo, NY, Rancho Dominguez, CA, or Erie, PA. All rights reserved and title to merchandise transfers to the buyer upon delivery to the carrier.
Delivery - The acceptance of shipment by common carrier shall constitute a delivery to the purchaser. Caplugs shall not be responsible for merchandise damaged or lost in transit.
Quantities - Order quantities will be increased or decreased to the nearest standard packaging quantity (Standard Carton or Mini Pak). Delivery of 5% more or less than the quantity order shall constitute fulfillment of the order for custom parts or standard parts run in nonstandard colors or materials.
Packaging - Caplugs reserves the right to change the quantities in its Standard Carton, Mini Pak or Micro Pak consistent with current packaging and/or shipping practices without notification. Micro Paks have a minimum purchase quantity of 2. Caplugs reserves the right to change minimum purchase quantities at any time, without notification.
Errors - Typographical and clerical errors are subject to correction.
Claims - All returns of standard cartons received within 30 days of shipment are subject to a 30% handling fee. Returns of standard cartons received 30 to 90 days after shipment are subject to a 50% handling fee. After 90 days, there are no returns. Mini and Micro Paks may not be returned. If the buyer claims parts are not as ordered, he or she must notify Caplugs within 30 days of delivery. O parts may be returned without a Return Authorization Number issued by the Caplugs Customer Service Department.
Specification - Standard Caplugs parts will be supplied in accordance with Caplugs' quotation and description in Caplugs' literature. Custom parts will be furnished in accordance with Caplugs' quotation and Caplugs' or buyer's drawings and/or specifications.
Cancellation - In the event of cancellation or deferral of deliveries on an order, the buyer assumes immediate liability for any completed part of the order, any material or tooling work performed, and may be asked for immediate payment of the charges involved.
Credit - Caplugs may refuse to make shipment unless previous invoices have been honored and satisfactory credit has been established.
Uses - The uses to which Caplugs parts are put are solely within the discretion and responsibility of the purchase and/or user. Purchaser of standard and custom Caplugs parts assumes any and all liability arising out of or in any way connected with the use of such standard or custom Caplugs parts and hereby agrees to indemnify Caplugs for such liability. Samples of standard catalog Caplugs parts are available at no charge for test evaluation.
Warranty - Caplugs are guaranteed to be free from defective material or workmanship for a period of 90 days from the date of shipment. This warranty shall be limited to the replacement of any defective part. Any part proving to be defective upon inspection at a Caplugs facility will be replaced. No allowance, credits, or reimbursements will be made unless authorized by Caplugs. All parts returned fore replacement must be accompanied by a Return Authorization Number.
Parts - Through continuous improvement efforts, we reserve the right to change part specifications, dimensions, pricing and quantities at our discretion without prior notice.
Tooling - All tooling remaining in Caplugs' possession will receive normal maintenance for the production of parts unless the tool has no production activity. For tools with high production activity, it may be necessary to refurbish or rebuild the tool at the buyers expense before additional parts can be produced. If 18 months pass without an order from the customer, the tooling will be abandoned.
